The deal between us.

1. Who these terms apply to

These terms govern your use of the 3PL Compare website (3plcompare.com.au) and our services, including the contract audit, the AU 3PL Pricing Index, the calculators, and any partner introductions we facilitate.

By using the site or submitting a contract for review, you agree to these terms. If you don't agree, please don't use the service.

2. The service we provide

The audit. We review the 3PL contract or rate card you upload and produce an advisory document benchmarking it against our verified market data. The audit is informed opinion based on data — it is not legal, financial, or contractual advice. Decisions about your fulfilment partners are yours to make.

The pricing index. We publish median rates and ranges for AU 3PL pricing. Sample sizes are stated on every figure. The data is collected from contracts brands have shared with us with consent, and from partner 3PLs under disclosure agreements. Index figures are accurate to the best of our knowledge but are aggregate signals, not specific quotes.

Introductions. If you opt in, we may match you with vetted 3PL partners. We charge those partners a per-introduction fee. We do not bid your data out to multiple providers. You are under no obligation to engage with anyone we introduce.

3. What we ask of you

When using our service, you agree to:

• Submit accurate, true information about your business.
• Only upload contracts and rate cards for which you are an authorised representative of the brand.
• Not submit anyone else's confidential information without their permission.
• Not misrepresent yourself, your role, or your authority to engage 3PL services.
• Not abuse the service (e.g. submitting fake contracts, scraping the index, automating audit requests).

4. What we promise (and don't)

What we promise

• To produce your audit within 48 hours of submission, on weekdays.
• To benchmark your contract against the most recent index data we have.
• To never share your contract or rate card with any 3PL partner.
• To disclose our funding model openly (per-introduction fees from 3PL partners — never from brands).
• To delete your data on request, within 7 business days.

What we don't promise

• We don't guarantee specific savings. Our audit identifies overpay relative to verified market median. Actual savings depend on your negotiation, your provider's willingness to move, and your switching execution.
• We don't guarantee 3PL partner performance. We vet partners against our criteria, but we are not their employer or agent. If a partner you engage performs poorly, please tell us — we will investigate and may remove them — but we are not liable for their service quality, contract execution, or commercial relationship with you.
• We don't provide legal advice. Our contract review identifies pricing and structural issues. For legal advice on contract enforceability, indemnities, or termination clauses, consult a qualified Australian commercial lawyer.

5. Our advisory recommendations

Recommendations in your audit (renegotiate, switch, or stay) are based on our analysis of the data you provide and our market index. They are professional opinions, not directives. You retain full control over your business decisions.

If we recommend partners through our matching service, we disclose that we are paid per-introduction. The recommendation is based on fit (volume, geography, capability), not on which partner pays us most. Every Verified Partner pays the same flat per-introduction fee.

6. Confidentiality

Your contract, rate card, and any business information you share with us is confidential. We treat it as such. See our Privacy Policy for full details on how we store, encrypt, and delete your data.

We may use anonymised, aggregated information from your contract to update the AU 3PL Pricing Index — but only with your explicit consent.

7. Intellectual property

The 3PL Compare website, the Pricing Index methodology, the calculator logic, and all content we publish remains our intellectual property. You may:

• Cite the index figures with attribution: "3PL Compare, AU 3PL Pricing Index, [month/year]."
• Use our calculators for your own decision-making.
• Quote excerpts from our articles with attribution and a link back.

You may not:

• Republish full articles without permission.
• Scrape the site or automate access for competitive purposes.
• Misrepresent our figures or strip attribution from cited material.

Your contract and rate card remain your IP. We don't claim ownership of anything you upload.

8. Limitation of liability

To the extent permitted by Australian law, our total liability to you for any claim arising from use of our service is limited to AUD $100. We do not exclude liability for fraud, gross negligence, or matters that cannot be excluded under Australian Consumer Law.

We are not liable for:

• Indirect, consequential, or special damages.
• Loss of profit, revenue, or business opportunity.
• Decisions you make based on our advisory output.
• Performance of any 3PL partner you engage as a result of our introduction.

9. Australian Consumer Law

Nothing in these terms excludes or limits your rights under the Australian Consumer Law where they cannot be excluded by contract.

10. Changes to the service

We may update or change the service over time. Material changes (e.g. introducing new fees, changing the audit process) will be communicated by email to brands who have engaged with us, and posted on the homepage.

If we ever introduce a paid offering for brands, it will be optional. Free brand services will remain free.

11. Termination

You may stop using the service at any time. We may decline to provide service to anyone who abuses it (e.g. scraping, fake submissions, repeated misuse).

Termination doesn't affect your data rights — you can still request deletion or export of any data we hold.

12. Governing law

These terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.
